Introduction
These Terms of Service ("Terms") govern your access to and use of AudienceDig's website, dashboard, and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of terms
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Using the Service
AudienceDig lets you submit YouTube video URLs and generates digests summarizing audience comments, including topic clustering, tone charts, and viewer persona profiles. You are responsible for ensuring you have the right to submit any video you analyze through the Service.
3. Accounts and registration
You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Subscriptions and billing
Paid plans are billed in advance on a recurring basis through our payment processor. You may change or cancel your plan at any time from billing settings. Switching to a different paid plan takes effect immediately: we charge the prorated difference when you upgrade, and refund unused time and tax to your original payment method when you downgrade. If you cancel or return to the Free plan, you keep your current plan until the end of the billing period.
5. Acceptable use
You agree not to misuse the Service, including by attempting to circumvent usage limits, submitting content you do not have the right to analyze, reverse-engineering the Service, or using it to violate any applicable law or third party's rights.
6. Intellectual property
AudienceDig and its licensors own all rights, title, and interest in the Service, excluding any content you submit or that is generated from your data. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal purposes.
7. Third-party content and YouTube data
The Service retrieves publicly available data from YouTube through its platform and APIs. Your use of the Service is also subject to YouTube's own terms of service. We are not responsible for the accuracy, availability, or continued provision of third-party data.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with notice where reasonably practicable.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, AudienceDig will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
